1. Hazard Designations

This waiver and the accompanying Safety & Operations Manual use the following signal words. All riders must understand these designations before operating a scooter.

⚠ Warning: Indicates the presence of a hazard that can cause severe personal injury, death, or substantial property damage if ignored.
⚠ Caution: Indicates the presence of a hazard that may cause minor personal injury or property damage if ignored.

2. General Safety Rules

The following safety rules apply to all mobility scooter models. Every operator must review and acknowledge these rules before using any scooter.

  • Read the entire Safety & Operations Manual before using any scooter.
  • Always turn the key switch off before getting on or off the scooter.
  • Always remain seated while the vehicle is in operation.
  • Keep legs on the platform while driving.
  • Always drive in a slow, sensible manner.
  • Drive slowly while turning and on inclines.
  • Always drive straight up and down inclines — never diagonally.
  • Drive to a complete stop before attempting to reverse.
  • Avoid sudden starts; accelerate gradually.
  • Approach obstacles at low speed if you intend to drive over them.
  • Lock the seat in position during vehicle operation.
  • Use the horn to alert pedestrians and avoid confrontations.
  • Be aware of mechanical pinch points, especially during assembly and disassembly.
  • Keep both hands on the tiller at all times.
  • Charge batteries daily when the scooter is in regular use (8–14 hours overnight).
  • Perform a pre-ride safety check: tires, wires, brakes, noises, and battery level.
  • Do not exceed the maximum weight capacity — may cause injury or damage.
  • Do not drive over or off obstacles more than 1 inch (2.5 cm) high.
  • Do not turn at high speeds — this could result in tipping.
  • Do not reverse down or park on a steep hill or incline.
  • Do not sit on the unit in a moving vehicle.
  • Do not allow anyone to ride with you.
  • Do not operate near stairs, steps, curbs, or terraces where a wheel might drop off the edge.
  • Do not operate on streets or other areas with vehicular traffic.
  • Do not disengage the brake on a slope or while someone is on the vehicle.
  • Do not leave the brake release in the freewheeling position.
  • Do not remove the anti-tip wheels or modify the scooter in any way.
  • Do not operate or turn on handheld communication devices (cell phones, CB radios) while the scooter is powered on.
  • Do not ride the scooter while it is wet.
  • Do not use an extension cord with the battery charger.
  • Do not smoke or allow open flame near the batteries.
  • Never ride in neutral/freewheel mode.

3. Operating Procedures Summary

Starting: Insert key into the tiller key switch and turn to ON. Set the speed dial to the slowest (tortoise) setting.

Moving Forward: Pull the right side of the accelerator lever toward you. The further you pull, the faster you go.

Reversing: Pull the left side of the accelerator lever toward you (or push the right side away). Reverse speed is slower than forward speed.

Stopping: Simply release the accelerator/throttle lever. The scooter will slow gradually and the brakes engage automatically.

  • Take wide swings around tight corners so the rear wheels clear.
  • When stopped on an incline, accelerate gently.
  • Going uphill — lean forward in the seat.
  • Going downhill — drive slowly.
  • Always drive straight up and down inclines, never diagonally.
  • All models can handle grass and gravel, but avoid long unkempt grass.
  • Only use curb cuts — never attempt to climb standard curbs.
  • Keep all 4 tires in contact with the ground at all times.

Approach unfamiliar doors slowly. Determine whether the door opens toward or away from you. If it opens away, drive through and allow a self-closing door to close behind you. If it opens toward you, hold the handle while gently pressing the reverse lever to open it, then switch to forward once the door is wide enough. In tight spaces, stop completely and then apply power gently while turning.

  • You are a motorized pedestrian — stay on the sidewalk as if you were walking.
  • Stay visible and approach pedestrians slowly.
  • Keep headlights on, if equipped.
  • Use the horn or your voice to alert people who cannot see you.
  • Drive carefully, slowly, and leave plenty of room to brake.
  • Signal with your hand when possible or use the horn.
  • Avoid sudden direction changes.
  • If you must cross a street, use crosswalks, make eye contact with drivers, and cross straight.

4. Battery & Charging Safety

4.1 Charge batteries daily when the scooter is in regular use. Charge for 8–14 hours in a dry location. Extended charging is safe and will not overcharge the batteries; deep discharge can damage them.

4.2 The battery meter uses a color code: green = fully charged, yellow = draining, red = immediate recharge needed.

⚠ Warning: Never use an extension cord with the battery charger. Plug the charger directly into a properly wired standard wall outlet. Removal of the grounding prong can create an electrical hazard.
⚠ Warning: Never smoke or allow an open flame near the batteries. Do not operate the charger in a closed-in area or restrict ventilation. Remove metal jewelry before servicing batteries. If batteries are damaged and a leak is apparent, contact us immediately — do not touch leaking batteries.

5. Electromagnetic Interference (EMI)

Power-operated vehicles may be susceptible to electromagnetic interference from radio stations, TV stations, amateur radio transmitters, two-way radios, and cellular phones. EMI can cause the scooter to release its brakes, move by itself, or move in unintended directions, and may permanently damage the control system.

⚠ Warning: Do not operate or turn on handheld communication devices while the scooter is turned on. If unintended movement or brake release occurs, turn the vehicle off immediately. Report all incidents to Folsom Mobility Scooter, LLC.

6. Weather & Environmental Conditions

6.1 Most devices resist light moisture but are not waterproof. Avoid heavy rain and dry the device after any exposure. Do not ride the scooter while it is wet.

6.2 Extreme heat drains batteries faster — park in shade when possible. Cold weather reduces battery performance — charge indoors when possible.

⚠ Warning: Do not expose the tiller console to moisture. If it becomes exposed, do not operate the scooter until the console has dried thoroughly.

7. Freewheel Mode

All models include a manual brake release lever that allows the scooter to be pushed without power. The lever is located at the top right of the rear section.

⚠ Warning: When in freewheel mode, the braking system is fully disengaged. Only engage on a level surface. Remove the key. Stand behind the scooter to engage or disengage freewheel mode — never sit on the scooter while doing this. Always return to drive mode afterward to lock the brakes.

8. Emergency Stopping

⚠ Warning: If the key is turned off while the scooter is in motion, the electronic brakes engage immediately, causing an abrupt stop. Use this only in emergencies.

9. Troubleshooting & Unusual Behavior

9.1 A main circuit breaker (reset button) is located on the battery pack. If the breaker trips, wait 1–2 minutes, then press the reset button. If it trips frequently, the batteries may need a load test by an authorized provider.

9.2 If you notice jerking movement, sudden power loss, or brake delay — stop using the device immediately and contact Folsom Mobility Scooter, LLC.

10. Assumption of Risk & Waiver of Liability

10.1 By signing this waiver, I acknowledge that I am voluntarily operating a mobility scooter provided by Folsom Mobility Scooter, LLC. I understand that operating a mobility scooter involves inherent risks, including but not limited to physical injury, tipping, collision, property damage, or other hazards.

10.2 In consideration of being permitted to operate a scooter, I hereby release, waive, and discharge Folsom Mobility Scooter, LLC, its officers, directors, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury sustained during operation.

10.3 I agree to indemnify and hold harmless Folsom Mobility Scooter, LLC from any loss, liability, damage, or cost incurred due to my operation of the scooter, including reasonable attorney fees and court costs.

10.4 I authorize Folsom Mobility Scooter, LLC to seek emergency medical treatment on my behalf if necessary. I understand that any medical costs incurred will be my sole responsibility.

Important: This waiver applies to all claims, whether caused by negligence, fault, or any other basis of liability, to the fullest extent permitted by applicable law.
